HB 2818

A city may request to be annexed into a special district in order to receive services from that district. Currently, if the district’s governing board approves the request, an election must be held to determine whether the annexation will take place. Voters within the city to be annexed also vote to decide whether to join the special district. However, the cost of holding such elections in larger special districts can be high. HB 2818 said that annexation elections are not required in cases where the population of the city to be annexed is less than 20 percent of the district’s population or the city’s boundary is entirely encompassed by that of the special district. An election could still be held if either 100 electors of the special district, or 10 percent of the special district’s electors, whichever is fewer, sign a petition requiring an election on the question. Residents of any city to be annexed would still be required to vote on the annexation.
